BallerTube Privacy Policy

1. Information We Collect

1.1 Information you give us

Account information. Name, email address, username, password, date of birth (used to confirm you are old enough to use the Service), role (athlete, parent, coach, program, fan, media, brand), and, if you choose, phone number and profile photo.

Athlete profile information. For an athlete profile you create or manage: athlete name, photo, graduation year, grade level, school, club or travel program, team, jersey number, position, height, weight, wingspan, city and state, statistics, honors, academic information you choose to add (such as GPA or test scores), social media handles, and any biography or write-up you provide. Every field except name and graduation year is optional.

Content. Video, images, audio, captions, tags, comments, news submissions, event listings, and everything else you upload or post, including information about other people who appear in that content.

Purchases. Items purchased, order history, billing name and address, and transaction identifiers. Payment card numbers go directly to our payment processor and are not stored by BallerTube.

Communications. Messages you send us, support requests, survey responses, event or sponsorship inquiries, and records of our correspondence.

Managed Athlete Profiles. If you are a parent or guardian creating a profile for an athlete under 13, we collect your own account information plus the athlete profile information you provide about the child, your confirmation that you are the child's parent or legal guardian, and a record of your consent. See Section 5.

1.2 Information other people give us about you

Other users may upload content in which you or your child appears, tag you, list you on a roster, submit news about you, or provide your contact information to us (for example, a coach adding a player, or an event operator sharing a bracket). Event operators, programs, leagues, and media partners may also provide rosters, schedules, results, and statistics. We treat this information under this Policy, and you have the same rights over it as over information you provided yourself.

1.3 Information we collect automatically

Device and usage data. IP address, browser type, device type and identifiers, operating system, referring pages, pages and videos viewed, watch time, searches, clicks, timestamps, and crash and performance data.

Approximate location. We derive a general location (city or region) from your IP address to show relevant events and content and to detect fraud. We do not collect precise geolocation from your device.

Cookies and similar technologies. We and our service providers use cookies, pixels, local storage, and software development kits to keep you logged in, remember preferences, measure traffic and video performance, and support advertising as described in Section 6. See Section 7 for your choices.

1.4 Information from third parties

Sign-in providers. If you sign in with Google or another provider, we receive the name, email address, and profile image you have authorized that provider to share.

Payment processors and fraud prevention services. Confirmation of payment, partial card information (such as last four digits and card brand), and risk signals.

Public sources. For Editorial Content, we gather publicly available information about athletes, teams, and events, such as box scores, brackets, rankings, press releases, and public social media posts.

1.5 Information we do not collect

2. How We Use Information

We use personal information to:

• create and operate accounts, athlete profiles, and Managed Athlete Profiles;
• host, transcode, stream, display, and recommend video and other content;
• publish and distribute Editorial Content, including game recaps, rankings, and event coverage;
• process purchases, deliver athlete content packages and other paid features, and send receipts;
• send transactional and activity notifications, such as upload confirmations, tag notifications, view and profile milestones, weekly recaps, and reminders (you can manage most of these in your settings);
• send marketing communications about BallerTube features, events, and partner offers, subject to your opt-out choices;
• personalize your experience, such as surfacing nearby events after you upload;
• measure and improve the Service, including analytics, testing, and product research;
• provide customer support and respond to requests;
• verify age, detect and prevent fraud, abuse, scraping, and security incidents, and enforce our Terms and policies;
• comply with law, respond to legal process, and protect the rights, safety, and property of BallerTube, our users, and the public; and
• produce aggregated or de-identified data, which we may use for any purpose, including investor and partner reporting. We commit to maintain de-identified data in de-identified form and not to attempt to re-identify it.

We do not use personal information for automated decisions that produce legal or similarly significant effects about you.

3. Public Information and Athlete Profiles

The Service is built for exposure and evaluation. The following are public and may be viewed, shared, embedded, and indexed by search engines by anyone:

• athlete profiles, including every field the profile owner or manager has filled in;
• videos, highlights, and other content posted publicly, together with the uploader's display name;
• comments, tags, and public interactions;
• event listings; and
• Editorial Content.

Your email address, date of birth, phone number, billing information, and private messages are never displayed publicly. Profile owners and managers can set a profile to private, hide individual fields, remove tags, and delete content at any time. Once content is public, other people may have copied or shared it, and we cannot control copies outside the Service.

4. How We Disclose Information

We do not sell personal information, and we do not disclose it to third parties for their own marketing. We disclose personal information only as follows:

Service providers. Companies that process information on our behalf and under our instructions, limited to what they need to perform their services: cloud hosting and content delivery, video transcoding and streaming, email and SMS delivery, payment processing, analytics, customer support tools, security and fraud prevention, and data storage and backup. The names of our current service providers in each category are available on request at privacy@ballertube.com.

Other users and the public. As described in Section 3.

Editorial and media distribution. Editorial Content, and public content it incorporates, may be syndicated to social media platforms and media partners.

Event operators, programs, and partners. If you register for, list, or purchase something tied to an event, program, or partner offering through the Service, we share the information needed to fulfill it. If we ever share personal information with a partner for the partner's own use, we will tell you at the point of collection and get your consent where required.

Advertising partners. See Section 6. We do not share personal information of users we know are under 18 with advertising partners.

Legal and safety. We disclose information when we believe in good faith it is required by law, subpoena, court order, or government request, or is necessary to enforce our Terms and policies, investigate fraud or abuse, protect the safety of any person, especially a minor, or defend our legal rights.

Business transfers. If BallerTube is involved in a merger, acquisition, financing, reorganization, or sale of all or part of its assets, personal information may be transferred as part of that transaction. The recipient will be bound by this Policy with respect to information collected under it, or we will notify you before your information becomes subject to a different policy.

With your direction. When you ask us to share information, such as sending a profile link or connecting a social account.

Aggregated and de-identified data. We may share aggregated or de-identified data, such as traffic, engagement, and demographic trends, with investors, partners, sponsors, and the public.

5. Children and Teens

5.1 No accounts under 13

You must be at least 13 to create an account. We ask for date of birth at signup in a neutral way and block signups by anyone under 13. If we learn that a child under 13 has created an account or provided personal information to us directly, we will delete the account and the information promptly. Report any such account to privacy@ballertube.com.

5.2 Managed Athlete Profiles for athletes under 13

• The parent is in control. Only the parent's account can create, edit, publish, unpublish, or delete the profile and its content. The child does not receive login credentials, and we do not collect any information online from the child directly.
• What we collect and why. Only the athlete profile information described in Section 1.1 that the parent chooses to provide, plus video and images the parent uploads. We use it to display the profile and content, to make them available to coaches and evaluators if the parent chooses to publish them, and to send the parent (never the child) account notifications. We do not ask for more information than is reasonably necessary for the profile, and we do not condition a profile on providing optional information.
• Step 1: consent before we keep anything. When a parent starts a Managed Athlete Profile, we first collect the parent's own account information and confirmation that they are the child's parent or legal guardian, and we show this Section. Nothing about the child is stored until the parent consents to collection and internal use. If the parent does not complete consent within 14 days, we delete whatever was entered.
• Step 2: separate consent, verified, before anything is public. Publishing a profile, video, or image of a child under 13, or syndicating it to social media, makes it available to other people, which children's privacy law treats as a disclosure. So before a Managed Athlete Profile or any of its content can be made public, the parent must give a second, separate consent to disclosure, and we verify that the person consenting is the parent or guardian using one of these methods: (a) a payment card or other online payment transaction that generates a notice to the account holder, such as the purchase of any paid feature or a small verification charge that we refund; (b) a consent form signed by the parent and returned to us by upload, email scan, or mail; (c) a match of a government-issued ID against a database, performed by our verification provider, with the ID deleted promptly after verification; or (d) any other method approved by the Federal Trade Commission. A parent may consent to Step 1 and decline Step 2, in which case the profile stays private and visible only to the parent's account. We record the date, time, method, account, and version of this Policy for each consent.
• What is public after Step 2. The profile and content are public to the same extent as any other profile (Section 3) until the parent sets it to private.
• No advertising use. We do not serve targeted advertising on Managed Athlete Profiles, do not share information from them with advertising partners, and do not use it to build advertising profiles. Persistent identifiers such as cookies are used on Managed Athlete Profile pages only to support the internal operation of the Service (login, security, playback, and non-personalized measurement), never for behavioral profiling.
• Who else receives the information. Apart from public display after Step 2, Managed Athlete Profile information is disclosed only to the following categories of service providers, for the stated purposes, under contracts that prohibit any other use: cloud hosting and content delivery (storing and serving the profile and video), video transcoding and streaming, data backup, security and fraud prevention, and customer support tools. The names of the specific providers in each category are available on request at privacy@ballertube.com. We never disclose it to any third party for that party's own purposes.
• Parent rights. At any time, the parent may review the information we hold about the child, correct it, withdraw either consent, direct us to stop collecting or using it, delete any of it, and delete the entire profile, through account settings or by emailing privacy@ballertube.com. We honor these requests without conditioning any other part of the Service on them, and on the timeline in Section A9 of the Minor Content Policy. We verify that the person making the request is the parent or guardian before acting.
• Retention. We keep Managed Athlete Profile information only as long as the profile is active and the consent remains in effect, and never indefinitely. When the profile is deleted or consent is withdrawn, we delete the information within 30 days and purge it from backups within 60 days.
• Content we produce ourselves. If BallerTube records or produces content featuring a child under 13, for example an athlete content package at an event, we do so only under a signed Athlete Media Release from the parent (Part B of the Minor Content Policy), which serves as the parent's verified consent, and the resulting content is handled under this Section.
• Conversion at 13. When the athlete turns 13, the parent may convert the profile into the athlete's own account under Section 5.3, or keep managing it.

5.3 Teens 13 to 17

Users 13 to 17 may use the Service only with the permission of a parent or guardian. At signup we collect a parent's or guardian's email address and send the parent a notice with a link to review and accept the Terms; the account is limited to viewing until the parent accepts. For these users we:

• do not serve targeted advertising and do not share their personal information with advertising partners;
• do not sell their personal information;
• apply the same retention limits as for adults, and honor deletion requests from the user or from a parent or guardian; and
• allow the user or a parent or guardian to remove tags, make a profile private, or delete content and accounts at any time.

California residents under 18 may request removal of content they posted publicly; see Section 8.

5.4 Minors appearing in content and Editorial Content

Athletes under 18 frequently appear in game film uploaded by teammates, parents, coaches, and programs, and in Editorial Content about competitions. Uploaders must have consent from a parent or guardian for every minor their content features, names, or tags, as required by our Terms and Minor Content Policy. A parent or guardian may ask us to remove a tag, remove a minor from content where technically feasible, or remove content, at privacy@ballertube.com. Section A9 of the Minor Content Policy sets the timeline and standards for these requests: we aim to acknowledge within 2 business days and act within 5 business days.

6. Advertising and Analytics

Audience. BallerTube is a general audience service used by adults and teens, with a section (Managed Athlete Profiles) that features children under 13. We treat athlete profile pages and Managed Athlete Profile pages as areas where minors are likely to be present, and we limit tracking there as described below.

Analytics. We use Google Analytics and similar tools to understand how the Service is used. We configure these tools to not collect precise location and to not use data from the Service for advertising personalization, and we do not enable advertising features, remarketing, or cross-device identifiers in analytics on athlete profile pages or Managed Athlete Profile pages. On those pages, persistent identifiers are used only to support internal operations such as login, security, playback, and aggregate measurement.

Advertising. The Service displays advertising and sponsored content to support free access. On athlete profile pages, Managed Athlete Profiles, and for any user we know is under 18, advertising is contextual only: it is selected based on the page content, not on personal information or browsing history. Elsewhere on the Service, advertising partners may use cookies and similar technologies to serve and measure ads based on your activity. Under California law this cookie-based activity is "sharing" for cross-context behavioral advertising, and under other state laws it is "targeted advertising." You may opt out through the "Do Not Sell or Share My Personal Information" link in the footer of every page, through Global Privacy Control, or as described in Section 7. We do not disclose personal information to advertising partners for their own use beyond what those cookies collect.

Sponsored content and partner placements. Sponsored articles, featured placements, and partner messages are labeled as such. If you interact with a sponsor's offer, the sponsor's own privacy policy applies to the information you give them.

7. Your Choices

Email and text. Unsubscribe from marketing email using the link in any message, or manage all notification types in account settings. Reply STOP to any text message to stop texts. Transactional and safety messages continue while you have an account.

Advertising cookies. Use the "Do Not Sell or Share My Personal Information" link in the footer of every page to turn off advertising cookies. Most browsers also let you block or delete cookies. Blocking essential cookies may break login and playback. We also honor the Global Privacy Control browser signal as an opt-out of cross-context behavioral advertising and any sale or sharing of personal information; the opt-out applies to the browser sending the signal and, if you are logged in, to your account across devices. You may also opt out of interest-based advertising from participating companies at optout.aboutads.info and optout.networkadvertising.org.

Profile visibility. Set a profile to private, hide individual fields, remove tags, or delete content and profiles at any time in account settings.

Account deletion. Delete your account in account settings or by emailing privacy@ballertube.com.

Do Not Track. Browser Do Not Track signals have no common standard, so we do not respond to them. We do respond to Global Privacy Control.

8. Your Privacy Rights

Depending on where you live, you may have the right to:

• Know and access the categories and specific pieces of personal information we hold about you, the sources, the purposes, and the categories of third parties we disclose it to;
• Correct inaccurate personal information;
• Delete personal information, subject to legal exceptions;
• Receive a portable copy of information you provided;
• Opt out of sale, sharing for cross-context behavioral advertising, targeted advertising, and profiling that produces legal or similarly significant effects (we do not sell personal information or engage in such profiling; see Section 6 for advertising opt-outs);
• Limit the use of sensitive personal information (we do not use sensitive personal information for purposes that require this right);
• Not be discriminated against for exercising these rights; and
• Appeal a decision we make on your request.

How to submit a request. Email privacy@ballertube.com or use the privacy request form in your account settings. Tell us what you are asking for and which account, profile, or content it concerns. We will confirm receipt within 10 business days and respond within 45 days, which we may extend once by 45 days with notice. There is no fee for reasonable requests.

Verification. We verify requests by matching the information you provide with information on your account, and may ask for additional information, such as confirming a code sent to the email on file. For requests about a Managed Athlete Profile or a minor's account, we will verify that you are the parent or guardian.

Authorized agents. You may use an authorized agent. We will require proof of the agent's authority and may verify your identity directly.

Appeals. If we deny a request, you may appeal by replying to our decision with "Appeal" in the subject line. We will respond within 45 days. If your appeal is denied, you may contact your state attorney general.

State-specific notices

California. This Policy describes the categories of personal information we have collected in the past 12 months (identifiers, customer records, commercial information, internet and network activity, approximate geolocation, audio and visual information, inferences, and characteristics of protected classifications such as age), the sources, the purposes, and the categories of recipients, as set out in Sections 1, 2, and 4. We have not sold personal information in the past 12 months. We may have "shared" internet activity information with advertising partners for cross-context behavioral advertising, as described in Section 6. We do not sell or share the personal information of any consumer we know to be under 16, and we use the date of birth collected at signup to enforce that. California residents under 18 who are registered users may request removal of content they posted by emailing privacy@ballertube.com; we will remove or anonymize it unless an exception applies, and removal may not extend to copies made by others. We do not offer financial incentives in exchange for personal information.

Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, Virginia, and other states with comprehensive privacy laws. You have the rights listed above to the extent provided by your state's law. We treat Global Privacy Control as a valid opt-out of targeted advertising. We do not process the personal information of any known minor for targeted advertising or sale.

Florida. We comply with the Florida Information Protection Act, including its breach notification requirements.

Nevada. We do not sell personal information as defined by Nevada law.

European Economic Area, United Kingdom, and Switzerland. The Service is directed to users in the United States. If we process personal data of individuals in these regions, we do so as a controller on the legal bases of contract performance (operating your account), legitimate interests (operating, securing, and improving the Service and publishing Editorial Content about public athletic competition), consent (marketing and non-essential cookies), and legal obligation. Individuals in these regions have rights of access, rectification, erasure, restriction, portability, and objection, and the right to lodge a complaint with a supervisory authority. Data is transferred to and processed in the United States under appropriate safeguards, including standard contractual clauses where required.

9. Data Retention

We keep personal information only as long as needed for the specific purpose it was collected for, and then delete or de-identify it. We do not keep any information about a child under 13 indefinitely. Our written retention schedule includes the following periods and purposes:

We may retain information longer where required by law, to resolve disputes, to enforce our agreements, or to protect the safety of any person, and we retain content removed for a Minor Content Policy violation as long as necessary for legal and safety purposes.

10. Security

We maintain a written information security program with administrative, technical, and physical safeguards appropriate to the sensitivity of the information we hold and the size of our business. These include encryption of data in transit, encryption of backups, hashed passwords, role-based access controls with the least access necessary, logging and monitoring, secure development practices, and annual review of the program. We designate a member of our team to coordinate the program, and at least once a year we identify and assess internal and external risks to personal information, including the personal information of children, and adjust our safeguards accordingly. We assess service providers before engaging them and require them by contract to protect personal information and to use it only for the services they perform for us. No system is completely secure. If a breach affects your personal information, we will notify you and the appropriate authorities as required by law, including Florida law, without unreasonable delay.

11. Where Information Is Processed

BallerTube is based in the United States and processes information there and in other countries where our service providers operate. If you use the Service from outside the United States, you understand that your information will be transferred to and processed in the United States, where privacy laws may differ from those in your country.

12. Third-Party Sites and Services

The Service links to and integrates with third-party sites, social platforms, and services. Their privacy practices are their own, and this Policy does not apply to them.

13. Changes to This Policy

We may update this Policy from time to time. We will post the updated Policy with a new effective date. For material changes, including any change that would allow new uses of information about minors, we will give at least 30 days' notice by email or a notice on the Service, and where required by law we will obtain consent before applying the change to information we already hold.
